The firm was established as Basham & Owen in 1975. Founding partner Mark W. Owen was joined soon thereafter by Ernest F. Bogart. The firm currently has five lawyers: Mark W. Owen, Ernest F. Bogart, Kathryn E. Rogers, Oskar Nisimblat and Elizabeth Owen. All are graduates of the University of Texas School of Law.

The firm is located in downtown Elgin at 105 E. 2nd Street, in a building owned by Mark Owen and Ernest Bogart which they restored in 1984 and 1985. Their offices are located on the third floor which can be reached by stairs or by the only pedestrian elevator in Elgin.
